पत्रकारों के चुनावी हांके के खिलाफ संघर्ष का शंखनाद

सत्ता के दलालों पर पेड न्यूज कानूनों में कार्रवाई का फैसला
भोपाल(पीआईसीएमपीडॉटकॉम)। आगामी विधानसभा चुनावों को देखते हुए मध्यप्रदेश के पत्रकारों को लामबंद करने के लिए चलाया जा रहा हांका कारगर नहीं होगा। इंडियन फेडरेशन आफ वर्किंग जर्नलिस्ट यूनियन से जुड़े पत्रकारों ने इस राजनीतिक षड़यंत्र के खिलाफ मोर्चा खोल दिया है। पत्रकारों ने फैसला किया है कि पत्रकारों का हांका करने में जुटे सत्ता के दलाल पत्रकारों को पेड न्यूज की ओर धकेलने के दोषी ठहराए जाएंगे।इस संबंध में सख्त कानूनी कार्रवाई करके दोषियों को दंडित भी कराया जाएगा।
इस संबंध में आज भोपाल में आयोजित बैठक में फैसला लिया गया है कि अगले महीने प्रदेश भर के पत्रकारों का एक सम्मेलन राजधानी के पत्रकार भवन में आयोजित किया जाएगा। जिसमें पत्रकारों के हित में प्रभावी संवाद कायम करने की रणनीतियों को अंतिम रूप प्रदान किया जाएगा।
आईएफडब्ल्यूजे जैसे देश व्यापी पत्रकार संगठन के सदस्यों ने मध्यप्रदेश में पत्रकारों की समस्याओं से निपटने के लिए ये कदम उठाया है। मध्यप्रदेश की स्थापना के बाद से निरंतर पत्रकार संगठनों से जुड़े रहे राजेन्द्र कश्यप की अध्यक्षता में हुई बैठक में शामिल पत्रकार साथियों का मानना है कि मध्यप्रदेश में पत्रकारों के हित में ठोस योजनाएं चलाई जाना जरूरी है। अब तक की व्यवस्था के तहत सरकारी सुविधाओं का लाभ कुछ चुनिंदा पत्रकारों को तो मिलता रहा है लेकिन जनहित में आवाज उठाने वाले पत्रकार भेदभाव के शिकार होते रहे हैं। पूर्ववर्ती दिग्विजयसिंह सरकार ने जिस सामंती अंदाज में पत्रकारों का शोषण किया उन हालात में कोई बड़े बदलाव नहीं हुए हैं। वर्तमान सरकार ने पत्रकारों और न्यूज चैनल, अखबारों की बढ़ती संख्या को देखते हुए बजट में तो भारी इजाफा किया है लेकिन सरकारी संसाधनों का लाभ अभी भी पत्रकारों तक नहीं पहुंच पाया है। प्रदेश में न तो श्रम कानूनों का पालन किया जा रहा है और न ही पत्रकारों की जीविका सुरक्षित है। पत्रकारों को जमीनी हालात से दूर रखकर जिन सीमित मुद्दों में बांधने का षड़यंत्र किया जा रहा है आईएफडब्ल्यूजे से जुड़े पत्रकार उन षड़यंत्रों को कारगर नहीं होने देंगे।
पत्रकार भवन भोपाल के मालिक संगठन आईएफडब्ल्यूजे से जुड़े पत्रकारों ने आज हुई बैठक में कहा कि कुछ पत्रकारों ने मिलते जुलते नाम वाले संगठन पंजीकृत करवाकर पत्रकारों को भ्रमित करने का प्रयास किया है। आईएफडब्ल्यूजे विशुद्धतः पत्रकारों का संगठन है और पत्रकारों के हित में संघर्ष करने का इसका लंबा इतिहास रहा है। आज जब पत्रकारिता में ठेकेदारी प्रथा बढ़ती जा रही है तब पत्रकारों को नए हालात के अनुरूप वेतन आयोग गठित करने की मांग भी इन पत्रकारों ने की है। वरिष्ठ पत्रकार आलोक सिंघई ने कहा कि जब देश में कर्मचारियों के वेतनमानों को लेकर सातवां वेतन आयोग गठित करने की प्रक्रिया प्रारंभ की जा रही है तब पत्रकारों के हित में इस तरह की वेतन प्रणाली लागू की जाए जिससे पत्रकारों को काम करने लायक माहौल दिया जा सके। उन्होंने पेड न्यूज पर सख्त नियंत्रण लगाए जाने की मांग भी की है।श्री सिंघई ने कहा कि आगामी चुनावों को देखते हुए पत्रकारों का हांका करने में लगे सत्ता के दलालों को सावधान हो जाना चाहिए क्योंकि उनके खिलाफ सबूत मिलते ही संगठन के सदस्य कानूनी कार्रवाई करेंगे ।

(Only salient features of the act)
Chapter 1 (Preliminary)
1)a) Short title and commencement.- this act may be called Working Journalists & other Newspaper Employees (Conditions of service) and Miscellaneous Provisions Act, 1955.
b) It extends to the whole of India, except the state of Jammu & Kashmir.
2) Definitions:
  • b) "Newspaper" means any printed periodical work containing public news or comments on public news and includes such other class of printed periodical work as many, from time to time, be notified in this behalf by central Government in the official Gazette.
  • c) "Newspaper Employees" means any working Journalists and includes any other person employed to do any work in or in relation to any newspaper establishment.
  • d) "Newspaper Establishment" means an establishment under the control of any person or body of persons, whether incorporated or not for any production or publication of one or more newspaper or for conducting any news agency or syndicate.
  • (f) "Working Journalists" means a person whose principal avocation is that of a journalist and (who is employed as such, either whole-time or part -time in, or in relation to, one or more newspaper establishment), and includes an editor , a leader writer , news-editor, sub-editor, feature-writer, copy-tester, reporter, correspondent, cartoonist, news-photographer and proof-reader, but does not include any such person who
    a) is employed mainly in a managerial or administrative capacity or
    b) being employed in a supervisory capacity, performs, either by the nature of duties attached to his office of by reasons of the power vested in him, and function mainly of a managerial nature.
Chapter 2 Working Journalist
3.).......

2) Sec 25-f of the aforesaid act, in its application to working journalist, shall be construed as in Cl. (a) thereof, for the period of notice referred to therein in relation to the retrenchment of a workman, the following periods in relation to the retrenchment of a working journalist has been substituted, namely - a) six months, in case of an editor, b) three months, in case of any other working Journalists.
Termination of Service without notice-Effect thereof-where a journalist was permitted to continue into employment even after he has attained the age of superannuation, but later on his service were terminated without giving him notice or retrenchment compensation, it was held by the court that the action of the management of the company in terminating the services was illegal and improper.
4) SPECIAL PROVISIONS IN RESPECT OF CERTAIN CASES OF RETRENCHMENT - Where at any time between 14 July 1954 and 12 March 1955, any working journalist had been retrenched he shall be entitled to receive from employer -
a) wages for one month at the rate to which he was entitled immediately before his retrenchment , unless he has been given one month notice in writing before such retrenchment; and
b) compensation which shall be equivalent to 15 days average pay for every completed years of service under that employer or any part thereof in excess of six months.
5)PAYMENT OF GRATUTITY 1:)WHERE
  • a) any working journalists has been in continuous service, whether before or after the commencement of this Act for not less than 3 years in any newspaper establishment and
    i) his services are terminated by the employer in relation to that newspaper establishment for any reason whatsoever, otherwise than a punishment inflicted by way of disciplinary action or
    ii) he retires from services on reaching the age of superannuation or
  • b) any working journalist has been in continuous service whether before or after the commencement of this Act for not less than 10 years in any newspaper establishment and he voluntarily resign on or after 1st day of July 1961 from services in that newspaper establishment on any ground what so ever other than on the ground of conscience or
  • c) any working journalist has been in continuous service whether before or after the commencement of this Act for not less than 3 years in any newspaper establishment and he voluntarily resigned on or after 1st day of July 1961, from services in that newspaper establishment on any ground whatsoever other than on the ground of conscience or
  • d) any working journalist dies while he is in service in any newspaper establishment

6) HOURS OF WORK
1) Subject to any rules that may be made under this Act, no working journalist shall be required or allowed to work in any newspaper establishment for more than 144 hours during any periods of 4 consecutive weeks, exclusive of time for meals.
2). Every working journalist shall be allowed during any period of 7 consecutive days rest for a period of not less than 24 consecutive hours, the period between 10 pm and 6 pm being included therein (Explanation - for the purpose of this section ,"week" means a period of 7 days beginning at midnight on Saturday.)
(Comment)
The maximum hour of work for any period of consecutive weeks is 144 hours.

Chapter 3 (Hours of Work)
7) SPECIAL PROVISIONS REGARDING EDITOR, ETC (HOURS OF WORK)-
The provision of this chapter shall not apply to editor, or to correspondants, reporters or news photographers
2) Not withstanding any thing contained in sub rule (1) the following provision shall apply to every correspondant, reporter , news photographer stationed at the place at wich the newspaper ( in relation to person is employed) namely
  • a) Subject to such agreement as may be arrived at either collectively or individually between the parties concerned, every correspondent, reporter or news photographer shall, once he enters upon duty on any day, be deemed to be on duty throughout that day till he finishes all the work assigned to him during the day.
    Provided that if such correspondent, reporter or news photographer has had at his disposal for rest any interval or intervals for a total period of two hours or less between any two or more assignments of work , he shall not be on duty during such period
    .
    Provided further that where the total period of such interval or intervals exceeds two hours he shall be deemed to be on duty during the period which is in excess of the said period of two hours.
  • b) Any period of work in excess of 36 hours during any week (which shall be considered as a unit of work for the purpose of this subrule) shall be compensated by rest during the succedding week and shall be given in one or more spells of not more than three hours each.
    Provided that where the aggregate of the excess hours worked falls short of three hours , the duration of rest shall be limited only to such excess.
8) NORMAL WORKING DAYS
The number of hours which shall constitute a normal working day for working journalists exclusive of time for meals shall exceed six hours per day in case of a day shift and five and half hours per day in case of night shift and no working journalist shall ordinarily be required or allowed to work for longer than the number of hours constituting a normal working day.
10) COMPENSATION FOR OVER TIME WORK -
When a working journalist works for more than six hours on any day in the case of day shift ,and more than five and half hours in case of night shift, he shall in respect of that overtime work, be compensated in the form of hours of rest equal in number to the hours for which he has worked overtime.
Chapter 4 (Holidays)
13) The number of holidays in a year
A working journalist shall be entitled to 10 holidays in a calendar year and
15)shall be entitled to wages on all holidays if he was on duty.
16)A working journalist shall be entitled to wages for weekly day of rest if he was on duty.
Chapter 5 (LEAVE)
LEAVES
Without prejudice to such holidays, casual leave or other kind of leave as may be prescribed, every working journalists shall be entitled to
25)a) Earned leave on full wages for not less than one-eleventh of the period spent on duty, provided that he shall cease to earn such leave when the earned leave due amounts to ninety days.
28) leave on medical certificate: 1) A working journalists shall be entitled to leave on medical certificate on one-half of wages for not less than one-eighteenth of the period of service
25EARN LEAVE -
1) A working journalist shall be entitled to earned leave on full wages for a period not less than one month for every eleven months spent on duty provided that he shall cease to earn such leave due amount to 90 days.
2)The period spent on duty shall include weekly days of rest , holidays, casual leave and quarantine leave.
29) MATERNITY LEAVE-
1) A female working journalist who has put in not less than one years service in the newspaper establishment in which she is for the time being employed shall be granted maternity leave on full wages on production of a medical certificate from an authorized medical practitioner for a period which may extend for three months from the date of its commencement or six weeks from the confinement which ever is earlier.
2) Leave of any other may be granted in continuation of maternity leave.
3) Maternity leave shall also be granted in case of miscarriage, including abortion, subject to the condition that the leave does not exceeds six weeks.
30) QUARNATINE LEAVE -
Quarantine leave on full wage shall be granted by newspaper establishment on the certificate of authorized medical practioner for a period not exceeding 21 days or In exceptional circumstances, 30 days.
31)EXTRAORDINARY LEAVE -
A working journalist who has no leave to his credit may be granted ,at the discretion of newspaper establishment in which such working journalist is employed leave not due.
33)Study leave may be granted in same pattern.
34) CASUAL LEAVE -
1)A working journalist shall be eligible for casual leave at the discretion of newspaper establishment for 15 days in a calendar year.
SETTING OF THE WAGE BOARD
For the purpose of fixing or revising rates of wages in respect of working journalists the Central Government shall as and when necessary constitute a wage board which shall consist of -
a) Three persons representing employers in relation to newspaper establishments
b) Three persons representing working journalists
c) Four independent persons, one of whom shall be a person who is or has been a judge of High court or Supreme court and who shall be appointed by the Government as the Chairman.
Powers of Central Government to enforce recommendations of the wage board
After the receipt of the recommendations of the wage board the Central Government without affecting the important alternation in the character of the recommendation can modify it. Friday May 30, 2003
IJU'S DEMANDS TO AMEND THE WORKING JOURNALIST ACT
  • 1. An amendment to make the non-implementation of wage awards a cognizable offence to ensure that no newspaper management gets away into not to implementing it.
  • 2. Amendment to increase the age of superannuation from 58 to 60 years.
  • 3. To amend the provisions of gratuity in working journalists act to provide for grant of gratuity after 5 year service.
  • 4. To make it mandatory for the employers to issue appointment letters to all mofussial and part-time correspondents, by whatever name called, according to a fixed forma as suggested by BACHAWAT WAGE BOARD

भोपाल: Ishtiaque आरिफ, उर्दू पत्रकारिता के अगुआ ने मंगलवार को भोपाल में यहां लंबी बीमारी के बाद अंतिम सांस ली.
     
Ishtiaque, वरिष्ठ पत्रकार, 87 वर्ष के थे और कैंसर से पीड़ित थे. वह अपने दो बेटों और दो ​​बेटियों को छोड़ गए हैं. उसकी पत्नी तनवीर आरिफ कुछ साल पहले मृत्यु हो गई. वह भी महिला खिलाड़ी जैसे विभिन्न विषयों पर उर्दू में लेखों का योगदान, बच्चों को वह उर्दू के 'महिलाओं पत्रिकाओं के पाठकों के लिए लेखक के नाम से जाना जाता था आदि ऊपर रखना.
उनका अंतिम संस्कार बड़े पैमाने पर भाग लिया.उन्होंने Saifia कॉलेज के पीछे बड़ा बाग कब्र यार्ड में ईशा की नमाज के बाद आराम करने के लिए रखी गई थी. वरिष्ठ राजनीतिक नेताओं, प्रतिष्ठित व्यक्तियों, रिश्तेदारों और शुभचिंतकों के स्कोर अलविदा उसे अंतिम बोली लगाने के लिए उनकी अंतिम यात्रा में भाग लिया.
     
उन्होंने Qasba Haswa, उत्तर प्रदेश में जिला Fatehapur पर 10 नवंबर 1922 को पैदा हुए और मुंबई से प्रकाशित उर्दू दैनिक खिलाफत में 1943 में एक पत्रकार के रूप में अपना कैरियर शुरू किया था.पत्रकारिता कैरियर के अपने 45 वर्षों में वह भी 25 साल के लिए 1948 से 1950 और रोज़नामा Afkar को रोज़नामा नदीम के संपादक थे. इसके अलावा, वह लखनऊ (1960) से प्रकाशित "Qaid" के संपादक थे और वह उर्दू दैनिक भास्कर समूह (1978) के आफताब ए Jadeed के संस्थापक संपादक थे.
उन्होंने यह भी स्वतंत्र आंदोलन में हिस्सा लिया और भी भोपाल विलय के आंदोलन में भाग लेने के लिए जेल में कई बार करने के लिए भेजा गया था. स्वतंत्रता संग्राम के दौरान उन्होंने लाहौर में महात्मा गांधी से मुलाकात की और उनके साथ हाथ मिलाया. यह भोपाल ब्रिटिश युग के दौरान नवाबों और Begums का शासन था कि यहां उल्लेख किया जा सकता है.
     
इसके अलावा पवित्र उर्दू Ishtiaque से अच्छी तरह से वह Sapray Sanghralay द्वारा प्रकाशित "उर्दू Sahafat" पर अपने क्रेडिट करने के लिए एक शोध पुस्तक है अरबी, अंग्रेजी, फारसी, संस्कृत आदि जैसे विभिन्न भाषाओं में निपुण था.
     
वह पहली संस्थापक सदस्य और भोपाल Shramjivi पत्रकार संघ (भोपाल वर्किंग जर्नलिस्ट यूनियन) के अध्यक्ष थे. उन्होंने कहा कि 1971 में मध्यप्रदेश उर्दू अकादमी की स्थापना में अपना सर्वश्रेष्ठ योगदान दे दी है और यह भी भोपाल, मध्य प्रदेश की राजधानी बनाने के लिए उसका सबसे अच्छा योगदान दिया.
     
उन्होंने कहा कि पुरस्कारों की संख्या के प्राप्तकर्ता था. तत्कालीन प्रधानमंत्री अटल बिहारी वाजपेयी ने उस पर 1982 में "फख्र ए Sahafat ऐज़ाज़" सम्मानित किया गया. उन्होंने कहा कि 1990 में मध्यप्रदेश श्रमजीवी पत्रकार संघ पुरस्कार और Sapray Sanghralay पुरस्कार प्राप्त किया, 1994 में स्वामी प्रनावानान्दा पत्रकार पुरस्कार, 1997.He में गणेश शंकर Vidhyarti पुरस्कार भी "अखिल भारतीय हकीम कमर उल हसन Sahafati ऐज़ाज़" प्राप्त किया.
     
मध्यप्रदेश उर्दू अकादमी Ishtiaque आरिफ को श्रद्धांजलि देने के लिए एक शोक सभा का आयोजन किया. उर्दू अकादमी के अध्यक्ष बशीर बद्र, प्रसिद्ध कवि, उपाध्यक्ष जफर बेग और सचिव सुश्री नुसरत मेहंदी उसे चमक श्रद्धांजलि अर्पित की और इस अवसर पर उर्दू पत्रकारिता को आरिफ के योगदान को याद किया.
     
देर पत्रकार को श्रद्धांजलि अर्पित करते हुए भारत के प्रमुख रास Herdenia के स्वामी प्रनावानान्दा पत्रकारिता ट्रस्ट उर्दू पत्रकारिता को आरिफ के योगदान को हमेशा याद किया जाएगा कि कहा गया है. उन्होंने आरिफ भोपाल अभी भी एक हिस्सा सी राज्य था जब पत्रकारिता के लिए ले लिया, और कुछ साल पहले तक पत्रकार के रूप में सक्रिय रहीं कहा.

The International Federation of Journalists (IFJ) has today launched a website dedicated to the safety and protection of media.

IFJ Launches Safety Website Dedicated to Campaign for Media Protection

The International Federation of Journalists (IFJ) has today launched a website dedicated to the safety and protection of media.

The website will provide a one stop portal for all IFJ activities to promote the safety of journalists and to combat the impunity for violence targeting media.

"With the continued onslaught on journalists in trouble spots around the globe, hundreds of reporters, editors and their support staff face persecution, intimidation, torture and even death simply for doing their job," said IFJ President Jim Boumelha.

"The International Federation of Journalists now plays a unique role in safeguarding the lives of journalists everywhere. The launch of the IFJ safety website marks a new chapter in our history, making it a vital tool for journalists and their unions to manage risk, raise awareness, provide safety training and advice, create a culture of safety and join the campaign to end impunity. "

The website provides information on the strategies, programmes and activities related to the safety and human rights of journalists, including details on the IFJ International Safety Fund.

There will be regular advice on safety for journalists who need to work or travel to regions affected by conflicts, political instability and outbreak of diseases as well as natural disasters.

The IFJ has over the years produced a wide range of tools designed to help journalists prepare for working in difficult environment and under their rights to life and physical security which are binding on governments.

"This new website will provide journalists with access to this material but also enable them to take part in the campaign we wage on their behalf," added Beth Costa, IFJ General Secretary. "We intend to make it as much interactive as possible and their views on the services we provide to them will be highly appreciated."

नई दिल्ली : मीडिया जगत में पत्रकारों एवं पत्रकारिता के साथ केंद्रीय सरकार एवं राज्य सरकारों द्वारा हो रहे दोगले व्यवहार से निपटने के लिये पत्रकार संगठन एकजुट हुए। बैठक में बीस से अधिक पत्रकार संगठनों के पदाधिकारियों ने शिरकत की, जिनमें समाचार पत्र प्रकाशक, श्रमजीवी पत्रकारों के संघ और समाचार चैनलों के एसोसिएशन ने भी एकजुटता के साथ एक महासंघ बनाने की बात पर सहमति जताई। पत्रकारों के इस महासंघ को अनेक गैर पत्रकारों संगठनों के अलावा डाक्टरों की अग्रणीय संस्था ‘इंडियन एसोसिएशन ऑफ पीडियाट्रिक सर्जन’ का भी पूर्ण समर्थन है। यह बैठक इंडियन मेडिकल एसोसिएशन के सभागार में संपन्न हुई।
पिछले काफी समय से पत्रकारिता जगत् में श्रमजीवियों, समाचार पत्र प्रकाशकों और समाचार चैनलों में केंद्रीय और राज्य-सरकारों की मीडिया विरोधी नीतियों के खिलाफ असंतोष व्याप्त है। इस असंतोष को समाप्त करने के लिये और एकजुटकता से सरकार के समक्ष अपनी मांगों का पक्ष रखने के लिए बैठक् हुई। इस बैठक में 20 से अधिक पत्रकार संगठनों ने हिस्सा लिया औश्र एक महासंघ बनाने पर सहमति हुई, जिनमें सात सदस्यीय सुप्रीम कोर्ठ कमेटी और वरिष्ठ पत्रकारों की सात सदस्यीय सलाहकार समिति बनाना तय हुआ। इस महासंघ में जल्द ही देश के तमाम छोटे-बड़े पत्रकार संगठनों को महासंघ के बारे में अवगत कराके शामिल किया जायेगा।

यह महासंघ विशुद्ध रूप से सिर्फ पत्रकारों एवं पत्रकारिता के हितार्थ एवं सहायतार्थ कार्य करेगा। महासंघ के गठन के मौके पर मीडिया फेडरेशन ऑफ इंडिया से जुड़े तमाम संगठनों के द्वारा, जर्नलिस्ट एसोसिएशन ऑफ इंडिया से श्री एच.के.सेठी, ऑफ इंडिया न्यूजपेपर सोसायटी से डा.आर.एल. गुप्ता, पॉलिटिकल भारत न्यूजपेपर से श्रीमति सीमा , न्यूज चैनल एसोसिएशन से श्री सुरेश चव्हानके, क्राइम वरियस से श्री संदीप चौहान, भारतीय दलित साहित्य अकादमी से डा. सोहनपाल सोनाक्षर, स्माल एंड मीडियम न्यूजपेपर एसोसिएशन ऑफ हरियाणा के श्री जी.सी.शर्मा, लीड इंडिया पब्लिशर्स एसो. से श्री सुभाष सिंह, न्यूजपेपर एसो. ऑफ इंडिया से श्री नितिन गौर, न्यूजप्रिंट मेन्यूफेक्चरर एसो. से श्री अनिस माहेश्वरी, यूनिटिंगि मीडिया ग्रुप से श्री काफिल अंसारी, राजधानी पत्रकार मंच से श्री विजय शर्मा उपस्थित थे। इसके अलावा डॉक्टरों की अग्रणी संस्था इंडियन एसो. ऑफ पीडियाट्रिक का भी समर्थन है। इसके पदाधिकारी सीनियर सर्जन, मौलाना आजाद, कॉलेज के डा. सतीश कुमार अग्रवाल, डा. अंजू गंभीर, डा. सिम्मी रतन ने पत्रकारों को शल्य चिकित्सा के बारे में महत्वपूर्ण जानकारी दी और पत्रकारों को समर्थन दिया।

भोपाल 18 सितम्बर 2013। दिल्ली से भी अच्छी मध्यप्रदेश की पब्लिसिटी है। जनसंपर्क मंत्री लक्ष्मीकांत शर्मा ने यह बात जनसंपर्क संचालनालय कर्मचारी बचत एवं साख सहकारी समिति के प्रतिभा सम्मान समारोह में कही।
जनसंपर्क मंत्री श्री शर्मा ने कहा कि जनसंपर्क एक ऐसा विभाग है जो सुबह 5 बजे खुलता और रात 12 बजे बंद होता है। उन्होंने कहा कि विभाग के अधिकारी-कर्मचारी कर्मठता और सजगता से कार्य करते हैं। श्री शर्मा ने कहा कि जनसंपर्क विभाग का नया सेटअप स्वीकृत करवाने की कार्यवाही प्रचलन में है।
जनसंपर्क मंत्री ने समारोह में समिति सदस्यों के प्रतिभावान पुत्र-पुत्री और सेवानिवृत्त अधिकारी-कर्मचारी को सम्मानित किया। उन्होंने समिति की वार्षिक स्मारिका का भी लोकार्पण किया।
समिति के अध्यक्ष वीरेन्द्र सिंह गौर ने समिति द्वारा किये गये कार्यों की जानकारी दी। उन्होंने कहा कि समिति के सदस्यों को अधिक से अधिक लाभ दिलवाने के हरसंभव प्रयास किये जायेंगे।

IFWJ flays BBC’s move to close bureaus in India



Patna,  Indian Federation of Working Journalists (IFWJ) has deplored and strongly condemned the reported move of the British Broadcasting Corporation (BBC) to abruptly close down all its bureaus in India from August 23, 2013.

In a statement its Secretary General, Parmanand Pandey, said this decision of the BBC management has come as a rude shock to the journalists of India that clearly betrays the insensitive, uncivilised and inhuman attitude of the BBC. It is also a sad reílection on the whimsical mentality and total disregard of the BBC management of its own policies being followed in the UK vis-a-vis its journalists in India.

The BBC bureaus in India,l it may be noted, have rendered commendable and credible news and commentary to the people of India even in the most dífñcult circumstances. lt is because of the dedicated services of journalists working for its bureaus, the BBC has earned credibility and laurels of all Indians across the board.
This resolution adopted at the national council session of the IFWJ held between June 30 and July 2 at Raipur, Chhattisgarh urged the BBC management to reconsider its decision.

However, if the management has fînally decided to wind up the bureaus in India, it must do so in accordance with rules and procedures as are followed by the BBC World Service in the UK.
The IFWJ has also called upon the government of India to immediately intervene in the matter and ask the BBC management to strictly abide by the relevant laws of the land so as protect the interests of the journalists and other employees who have been working with it for quite long period.
The IFWJ has warned the BBC management that if just and fair treatment is not meted out to senior journalists of its bureaus in India, it will resort to appropriate actions including the legal and direct ones.

MP journalists to get govt honorarium July 26, 2012

Bhopal, July 25
Madhya Pradesh Government has decided to a pay an honorarium of Rs 5,000 per month to journalists, who are over 62-years-old.
The decision was taken by the State Cabinet at its meeting chaired by Chief Minister Shivraj Singh Chouhan last evening, official sources said.
The other conditions to qualify for the scheme are that the journalist should be accredited with the state government for over 10 years, should not be dependent on any member of his/her family and should not be an income tax payee.
The journalistic fraternity has widely hailed the State Government’s decision to give honorarium to senior journalists. Various journalist associations have expressed gratitude towards Chief Minister Shri Shivraj Singh Chouhan for the decision.
It may be mentioned that the cabinet has decided to give Rs. five thousand per month honorarium to senior journalists. Its benefit will be given to accredited journalists of over 62 years of age.
Lauding the State Government’s decision, Central Press Club member Shri Ganesh Sakalle and general secretary Shri Rajesh Sirothiya said that this decision is in the interest of journalists. Madhya Pradesh Working Journalists Union’s State President Shri Shalabh Bhadoria has also expressed gratitude over the decision.
Indore Press Club president Shri Praveen Khariwal said that entire media welcomes this decision. Indore’s senior journalists have also hailed the decision. Expressing gratitude, president of Rewa Working Journalists Union Shri Akhilesh Pandey and general secretary Shri Purushottam Mishra said that the decision has fulfilled long-pending demand of journalists.
Expressing pleasure over the decision, journalists from all over the state including Gwalior, Jabalpur and Ujjain have also expressed gratitude towards Chief Minister Shri Chouhan. Welcoming the decision, General Secretary of Madhya Pradesh Journalists Union Shri Nalinkant Vajpayee, Divisional president Shri Parmanand Tiwari, Jabalpur Working Journalists Union Shri Rafiq Khan, Secretary of Journalists Union of Madhya Pradesh Shri Pankaj Pateria, district president Shri Chaitanya Bhatt, Working Journalist Union State Secretary Shri Prahlad Sahu Nephaisle have expressed gratitude towards the Chief Minister Shri Chouhan for the decision. In Gwalior, Working Journalists Union state organising secretary Shri Vinay Agrawal, state general secretary Shri Suresh Sharma, senior journalist Shri Rakesh Achal, Shri Praveen Mishra and others also expressed gratitude towards Chief Minister Shri Shivraj Singh Chouhan.

BHOPAL: One person was shot dead and another, a journalist with a local Hindi daily was injured when two miscreants opened fire on them near the second number bus stop in Tulsi Nagar area here, police said on Saturday.

The incident took place last night, they said. The miscreants fired 3-4 rounds and one bullet grazed the hand of journalist Aadesh Singh Bhadoria.

The election is to take place tomorrow. The learned Single Judge has stated that according to the law declared by the Supreme Court, the Writ Court cannot interfere in the process of election. The learned Single Judge also dismissed the writ petition holding that interference in the election process is not permissible. It is not disputed that the order sought by the appellant, is granted would interfere with the ongoing election process. Learned counsel for the appellant has argued that because the error is apparent, therefore, the writ Court should have interfered in the process of election. Unfortunately, no such exception has been permitted by the Apex Court.
We do not find any error in the order passed by the learned Single Judge. There is no force in this appeal. Accordingly, the same is dismissed.

Veteran Bhopal Journalist Ishtiaque Arif passes away Friday, October 23, 2009

Bhopal: Ishtiaque Arif, the doyen of Urdu journalism, breathed his last after prolonged illness here in Bhopal on Tuesday.
     
Ishtiaque, the veteran journalist, was 87 and was suffering from cancer. He is survived by his two sons and two daughters. His wife Tanwir Arif died a few years back. She also contributed articles in Urdu on various topics like women players, children up-keep etc. She was known writer to the readers of ladies’ magazines of Urdu.

His funeral was largely attended. He was laid to rest after Isha prayers at Bada Bagh grave yard behind Saifia College. Scores of senior political leaders, eminent personalities, relatives and well wishers took part in his last journey to bid him final good-bye.
     
He was born on November 10, 1922 at Qasba Haswa, District Fatehapur in Uttar Pradesh and started his career as a journalist in 1943 in Urdu daily Khilafat published from Mumbai. In his 45 years of journalistic career he was also editor of Roznama Nadeem from 1948 to 1950 and Roznama Afkar for 25 years. Besides, he was editor of “Qaid” published from Lucknow (1960) and he was founder editor of Urdu daily Aftab-e-Jadeed of the Bhaskar group (1978). 

He also took part in the Independent Movement and was also sent to jail many a times for participating in the Bhopal merger movement. During the freedom struggle he met Mahatma Gandhi in Lahore and shook hands with him. It may be mentioned here that Bhopal was ruled by Nawabs and Begums during British era.
     
Apart from chaste Urdu Ishtiaque was well versed in various languages like Arabic, English, Persian, Sanskrit etc. He has to his credit a research book on “Urdu Sahafat” published by Sapray Sanghralay.
     
He was the first founder member and president of Bhopal Shramjivi Patrakar Sangh (Bhopal Working Journalist Union). He gave his best contribution in the establishment of Madhya Pradesh Urdu Academy in 1971 and also gave his best contribution for making Bhopal, the capital of Madhya Pradesh.   
     
He was recipient of number of awards. The then Prime Minister Atal Bihari Vajpayee conferred on him "Fakhr-e-Sahafat Aizaz" in 1982. He received Madhya Pradesh Shramjeevi Patrakar Sangh Award & Sapray Sanghralay Award in 1990, Swami Pranavananda Patrakar Award in 1994, Ganesh Shankar Vidhyarti Award in 1997.He also received the "All India Hakeem Qamar-ul-Hasan Sahafati Aizaz".
     
Madhya Pradesh Urdu Academy held a condolence meeting to pay homage to Ishtiaque Arif. Urdu Academy chairman Bashir Badr, the renowned poet; vice chairman Zafar Baig and secretary Ms Nusrat Mehndi paid glowing tributes to him and remembered Arif's contribution to Urdu journalism on the occasion.
     
Paying tributes to the late journalist, the Swami Pranavananda Journalism Trust of India chief L. S. Herdenia has said that Arif's contribution to Urdu journalism would always be remembered. He said that Arif took to journalism when Bhopal was still a part C state, and remained active as journalist until a few years back.

Sikkimese journalist robbed in New Delhi

After the Sikkim Federation of Working Journalists (SFWJ) approached its parent body Indian Federation of Working Journalists (IFWJ) based in New Delhi on robbery of Sikkimese journalist Duk Nath Nepal in New Delhi recently, the Secretary General of IFWJ, Parmanand Pandey, took up the matter with Delhi Police.
In his response to the SFWJ’s request, Pandey, in a communiqué to SFWJ President Jigme N Kazi, said he has already spoken to the Deputy Commissioner of Police regarding the robbery, informs a press release issued by the SFWJ today. Pandey is hopeful that Delhi Police, which had been apprised of the matter when the robbery took place in the night of June 27, 2012, will act on the complaint.
“However, if nothing happens in two-three days, we will decide further course of action,” Pandey, a senior lawyer of the Supreme Court, said in his message to Kazi.
Nepal, Editor of Shangrila Times, a Gangtok-based Nepali daily, who was accompanied by Madhusudhan, were robbed of their cash and other belonging, including a laptop, at knife point by a group of unidentified miscreants near Anand Vihar in New Delhi. The total amount of loss is around Rs. 2 lakhs.
The victims approached the police and a case has been registered at the IP Estate police station. After robbing the victims, the assailants fled in their Innova car. The incident took place near the Delhi Police Headquarters.

16. Section 10 of the Act provides for reference of disputes to Boards, Courts or Tribunals. This section, inter alia, provides that where the appropriate Government is of the opinion that any industrial dispute exists or is apprehended, it may at any time, by order in writing refer the dispute or any matter appearing to be connected with, or relevant to, the dispute if it relates to any matters specified in the Second Schedule to a Labour Court for adjudication or refer the dispute or any matter appearing to be connected with or relevant to the dispute, whether it relates to any matters specified

Kasturi & Sons case (supra) the employer/petitioner company before the Supreme Court was the proprietor of a daily newspaper 'The Hindu'. The first respondent N. Salivateswaran, a Journalisthad been supplying news to various newspapers and journals, one of which was 'The Hindu'. That supply was under an agreement under which respondent No. 1 was being paid a fixed monthly honorarium. Contrary to the advice and instructions of the employer the first respondent left India for Zurich on May 1, 1956 and thereupon the employer relieved him of his duties and terminated with effect from March 1, 1956, the arrangement under which he was supplying news to The Hindu. Respondent No. 1 returned to India in July 1956 and requested the employer to reconsider the decision but the employer did not think that any case for reconsideration had been made out. Thereupon the first respondent made an application under Section 17 of the aforesaid act. The State of Bombay nominated a retired ICS Officer under Section 17 of the Act for the purpose of enquiry into the first respondent's application and requested him to examine the claim made by the first respondent and in case he was satisfied
claim in the appropriate civil Court. On the preliminary issue of jurisdiction the nominated authority held that he had jurisdiction to deal with the matter and that it was unnecessary to direct the first respondent to establish his claim in the ordinary civil Court. This order led to the employer filing a petition under Article 32 of the Constitution before the Supreme Court. The case of the petitioner/employer before the Supreme Court was that Section 17 provides only for a mode of recovery of any money due to a working journalist and it does not empower the State Government or authorities specified by the State Government to act as a forum for adjudicating upon the merits of the disputed claim. Before the Supreme Court one of the contentions of the employer was that the condition precedent for application under Section 17 is a proper determination by a competent authority or the court of the amount due to an employee from the employer and it is only if and after the amount due to the employee has been duly determined that the stage is reached to recover that amount and it is at this stage that the employee is given

(4) It appears that in an industrial Dispute between the appellant and its workmen (being Industrial Dispute No. 29 of 1959), the ageof retirement was fixed by the Industrial Tribunal at 55 years, but in appeal before the Supreme Court the age of retirement was raised to 58 years. In May 1963, respondent No. 1 reached the age of 58 years and retired from service. In the scheme of gratuity for the benefit of non-journalist staff (like respondent No. 1) the award had provided as under:--

The Labour Court had held that the mention of the word "wages" in the gratuity scheme included the total amount payable on account of pay and dearness allowance. In doing so, the Labour Court held that the words used in the scheme were "salary" or "wages". This means that the two words have the same meaning. The word "wages" has been defined in Section 2(rr) in the Industrial Disputes, Act. 1947 as meaning all remuneration capable of being expressed in terms of money and includes allowances such as dearness allowance. The same definition has been given to that word in the Payment of Wages Act, the Minimum Wages Act and other statutes where the word has been defined. The Labour Court therefore held that the gratuity is to be calculated on the total amount payable to a workman as pay and dearness allowance
being paid to the journalists by virture of the provisions of the Working Journalists(Conditions of Service) and Misc. Provisions Act, 1955 there was no gratuity scheme in the case of non-journalists in the same establishment. The union representing the workmen had suggested that they would be satisfied if the scheme in so far as it applied to journalists, was adopted for the non-journalists. The Tribunal had also before it the terms and conditions of the workmen employed by Messrs Bennet, Coleman & Company Limited where while granting gratuity it was specifically made clear that pay shall include only basic pay for this purpose and yet the Tribunal did not choose to so limit the award while making gratuity scheme in the present case.
learned Single Judge was of Bennet.Coleman& Co. Limited. In that case gratuity had been granted on the basis of basic wages and not consolidated wages. There was also no evidence about the fiourshing nature of the concern and the enormous profits it was making. There was also no evidence of reserves built up by the concern and all that was stated was that gratuity was being paid to journalist on the basis of consolidated wages. If the Labour Court and the learned Single Judge wanted to base their decision on the flourishing nature of the concern and other matters they should have said so and evidence should have been called in that behalf. The Labour Court however went into the definition of wages in the Industrial Disputes act. 1947 and so it seems, was done by the learned Single Judge,for it was observed that the award not having limited the meaning of wages to mean basic wages, there was no reason why the definition of the word wages as including all wages be not accepted. It appears that the petitioner was in employment of Respondent No.3. He was transferred from Bhopal to Lucknow. There is a dispute whether the petitioner rendered any service to Respondent No.3 after his transfer to Lucknow.
