Working Journalists Union Bhopal vs Principal Secretary The State Of ... on 1 February, 2012
W.A. No.104/2012
01.02.2012
Shri A. D. Mishra, learned counsel for the appellant. Shri Kumaresh Pathak, learned Dy. Advocate General for the respondents/State.
Heard.
The election is to take place tomorrow. The learned Single Judge has stated that according to the law declared by the Supreme Court, the Writ Court cannot interfere in the process of election. The learned Single Judge also dismissed the writ petition holding that interference in the election process is not permissible. It is not disputed that the order sought by the appellant, is granted would interfere with the ongoing election process. Learned counsel for the appellant has argued that because the error is apparent, therefore, the writ Court should have interfered in the process of election. Unfortunately, no such exception has been permitted by the Apex Court.
We do not find any error in the order passed by the learned Single Judge. There is no force in this appeal. Accordingly, the same is dismissed.
(Sushil Harkauli) (Tarun Kumar Kaushal) Acting Chief Justice Judge
